Digital Services Act

On October 19, 2022, the EU Regulation 2022/2065 on a Single Market for Digital Services and amending Directive 2000/31/EC (Digital Services Act) was adopted. The Digital Services Act will come into effect on February 17, 2024. On this page, all interested parties, including public authorities and our users, can find relevant information that Webtasy, d.o.o. is obligated to provide as a provider of intermediary services, in accordance with the provisions of the Digital Services Act.

 

Contact Point

The designated single point of contact for direct communication with the authorities of the Member States, the Commission, and the Boards with Webtasy, d.o.o., in accordance with Article 11 of the Digital Services Act, is the following email address: info@domenca.com.

Communication with the designated contact point mentioned above is possible in both Slovenian and English.

In accordance with Article 12 of the Digital Services Act, Webtasy, d.o.o. also designates the following email address as a point of contact for service recipients to communicate directly with Webtasy, d.o.o.: info@domenca.com.

 

Reporting Illegal Content

In accordance with Article 16 of the Digital Services Act, any individual or entity can notify Webtasy, d.o.o., as a hosting service provider, that its service includes specific content that they believe constitutes illegal content.

For the purposes of implementing Article 16 of the Digital Services Act, Webtasy, d.o.o. provides the following instructions for submitting a notice of illegal content.

Content of the notice of illegal content:

  • NOTIFIER: (Full name or name of the organization and the full name of the legal representative)
  • CONTACT OF THE NOTIFIER: (Email address)
  • JUSTIFICATION FOR WHY THE NOTIFIER BELIEVES THE CONTENT IS ILLEGAL
  • SPECIFICATION OF THE EXACT ELECTRONIC LOCATION: (URL address)
  • STATEMENT OF ACCURACY AND COMPLETENESS: (By submitting this notice, the notifier declares in good faith that the information and statements in the notice are accurate and complete.)
 

In the case of reporting information that is considered to include any of the criminal offenses outlined in Articles 3 to 7 of Directive 2011/93/EU, the notifier is not required to provide the information specified in points 1 and 2.

Information on Content Moderation and Content Restrictions for Service Recipients

At Webtasy, d.o.o., we conduct content moderation and impose content restrictions for service recipients (hereinafter referred to as users) based on general industry practices for web hosting services in relation to content moderation. We also adhere to legal guidelines regarding the liability for illegal third-party content when Webtasy, d.o.o. becomes aware of such content (removal or restriction of access to content via the internet).

If we receive a notice of illegal content or learn about it through other means, we will notify the user via email and request a response. We will instruct the user to inform us whether the illegal content has been removed, or if the user believes the notice of illegal content is unfounded, to provide an objection with an explanation. We provide the user with a contact point (email address) to use for these responses. We set a reasonable deadline for the response in accordance with the law. The user will receive either an automatic or manual message from our abuse handling team. After the deadline has passed, and if the user has not yet responded, an automatic reminder will be sent. Webtasy, d.o.o. reserves the right to restrict access to the disputed content via the internet after the deadline has passed and once a member of the abuse handling team has manually reviewed the disputed content. The restriction will remain in effect until the user removes the content and/or submits a statement or objection to the abuse handling team. The legal basis for this process is point B.9 of our General Terms and Conditions (https://www.domenca.com/en/terms-and-conditions/) and other legal bases.

The user may request the removal of the content restriction at any time by confirming in writing that the disputed content has been removed or by objecting to the notice. To maintain the integrity of our network, we cooperate with several organizations that maintain blacklists. If one of our users has an IP address listed on a blacklist, the user will receive an email notification (as described above). We monitor the metadata of sent packets to help identify and mitigate online abuses and DDoS attacks. If we determine that the sent packets are not suitable for their intended purpose (facilitating communication), the user will receive a notice of illegal content (as described above).

Content Moderation Reports

In accordance with Article 15 of the Digital Services Act, hosting service providers must publicly publish annual reports on all content moderation activities they have undertaken during the relevant period.

Webtasy, d.o.o. will publish annual reports on this page in accordance with Article 15 of the Digital Services Act.
